"It's Over For Magu, Buhari Can Not Send His Name To Senate Again" - Dino Malaye
Senator representing Kogi West, Dino Melaye has said that following the Senate rejection of the nomination of Mr. Ibrahim Magu as chairman of the Economic And Financial Crimes Commission (EFCC) on two different occasions, President Muhammadu Buhari cannot validly re-nominate the same candidate again.
Melaye while commenting on the debate in the media about whether Magu can continue to act as EFCC boss in spite of his failure to be confirmed by the Senate or if the President can renominate him, Melaye said there is a provision of the Senate rules which would not allow members consider Magu for the same position again.
Citing Order 131 of the Senate Rules, Melaye said after the rejection of Magu's nomination, his candidacy is considered lapse and therefore advised the President to consider a fresh nominee who is qualified, in terms of experience, integrity, knowledge and temperament to lead the anti-graft agency.
Order 131 of the Senate Rules states that "nominations neither confirmed nor rejected during the session or within 21 working days in the case of Ministerial nominees shall be returned by the clerk to the National Assembly to the President of the Federal Republic of Nigeria and shall not again be made to the Senate by the President of the Federal Republic of Nigeria".
The Senator who insisted that Magu did not impress anybody including those Senators who would have been sympathetic to his cause during the confirmation hearing in the Senate urged President Buhari to look for a replacement and avoid actions that may result in violation of the laws of the land.
"Those suggesting to the President that after failing to scale the confirmation process twice, the President should leave Magu to be acting are only recommending violation of the law, disrespect for due process and perpetration of illegality. All these will only undermine democracy and constitutionalism in our country.
"Those drafters of the law who made the provision that the Senate should confirm the nomination of the EFCC chairman did not make any mistake and nobody should observe the law in the breach by getting a person into that office who has not been confirmed".
Woman Who Used Charm To Steal Been Arrested In Lagos By Police After The Charm Failed (See Photos)
A single mother, Ayobami Ojo, who reportedly prepared a native charm, which she used to steal from people, has been arrested after the charm failed her.
The Oyo State-born woman was arrested where she used the charm to steal from a shop owner, Mrs Olatade Olubukola at 18 Mufutau Adeyemi Street, Orelope in Idimu area of Lagos.
Ms. Ojo who had reportedly used the charm to steal from more than 30 victims, as usual went to Olubukola demanding that she should give her the sum of N13,000, though Olubukola gave her the money, but when Ms. Ojo was walking away thinking that her charm has worked, Olubukola confronted her.
She reportedly attempted to escape by invoking her charm to silent Olubukola, but the charm failed her. This made the shop owner to raise an alarm which attracted the neighbours who apprehended the suspect.
She was handed over to the police at Idimu division where she confessed that she had been using charm to steal from people but she did not know that she would be caught at Olubukola’s shop.
The woman later confessed that whenever she used the charm, it would enable her to disappear.
She was charged before the Magistrates Court sitting at Ejigbo. She pleaded not guilty. The Presiding Magistrate, Mr Akeem Fashola granted her bail in the sum of N20,000 with one surety in the like sum. She was remanded in prison custody pending when she would fulfill her bail conditions.
The matter was adjourned to 4 April 2017 for hearing.

Femi Falana Says Senates Can’t Compel Customs Boss, Hameed Ali To Wear Uniform
Human rights lawyer, Mr. Femi Falana (SAN), has stated categorically that Senate lacks the power to compel Hameed Ali to wear Customs uniform.
Falana said there was no law stipulating that the Comptroller-General of Customs must wear the Nigerian Custom Service’s uniform.
He added that, although Ali was the Comptroller-General of Customs, the retired military officer was not a member of the service.
Speaking with Punch, Falana said, “With respect to the customs service, its officers are required to wear uniforms. But since the CGC is not a serving customs officer the senate lacks the vires to force him to wear any uniform.
“The suit challenging the legal validity of Col. Hameed Ali’s appointment has been dismissed on the ground that the President has the power to appoint a non-customs officer to head the customs service. Since the court has held that he is not a customs officer, Col. Ali cannot be made to wear any uniform.
"I challenge the Senate to refer to any law that supports the wearing of uniform by the head of customs service, who is not a serving customs officer".
Falana added that customs officers are not being made to wear uniforms in other countries including South Africa.
He said, “In many countries, including South Africa, customs officers do not wear uniforms.
“In Nigeria they wear uniforms because under the defunct military junta security agencies claimed that they were either military or paramilitary forces. It was part of the intimidation of the civilian population.”

Oyo State Government FRSC Make New Rules On Okada Riders (See Photos)
Today is the last day any commercial motorcycle rider can operate without a valid licence and crash helmet in Oyo state, according to the Federal Road Safety Commission (FRSC).
The commission has vowed it will deal decisively with defaulters, including those operating without a registration plate.
A communique from a safety awareness programmed organised by the community relations unit of the state government which had in attendance the Oyo Governor Isiaq Ajimobi insisted that motorcycles being used for Okada must be road worthy and must have the two side mirrors fixed on them.
Accordingly, operators must provide helmets for their passengers, will carry only one passenger at a time without any loading, and alcohol will no longer be sold in motor parks.
"Oyo State Government does not intend to ban okada riders but we are charged with the responsibility to protect the lives of our citizenry and that is why we need to partner with law enforcement agencies to enforce the usage of helmet. They must be cautious on the highway and must begin to use helmet,” the governor said through a representative.
'Thousands of helmets were distributed to them last year but we observe that some of them are not using it and are keeping it at home. They also engage on overload thereby endangering the lives of their passengers and creating social problems. All this are causing overstretching of government facilities in hospitals."
Oyo Sector Commander of the FRSC, Yussuf Salami, said: "Any Okada rider caught without helmet is fined N10, 000 but I think if we can increase the fine in partnership with the Oyo State Government, so many Okada rider will adhere strictly to the rules and regulation. Many Okada riders in this state needs attitudinal change and are inpatient. They are even ungrateful to government because they should have banned them.
"If we now charge them N30, 000 for non-usage of safety helmet, I know they will change. I will even advice the state government to state conducting psychiatric test on them because most of them behave abnormal while riding. Even Okada riders unions unit that ought to discipline their members are only interested in their daily dues. So many deaths has been recorded in this state from Okada accidents"
He urged the state government to have a database for all Okada riders in the state and give them same uniform in order to curb crimes.
Similarly, the Special Adviser to the Government on Community Relations, Alhaji Abidemi Siyanbade said a typical Okada rider is not patient, adding that they ride the Okada as if they are the only people using the road.
He said: "Another appalling habit of Okada riders is harassment of other road users especially anytime there is an accident involving one of them. Whether they are guilty or not, they will want to solidarise with their fellow Okada rider involved in an accident and in the process, harass and threaten other road users"
Father Who Got Arrested Says He Swallowed 66 Wraps of Drug In Other To Save His Dying Son
When 43yrs old Anukaenyi Bob-Manuel Ogochukwu was caught on the suspicion of being a drug courier at the Murtala Muhammed International Airport, Lagos on Wednesday, he initially denied having anything to do with drugs.
NDLEA Commander at the Lagos airport, Ahmadu Garba, said the suspect was apprehended during the inward screening of passengers on an Ethiopian Airline flight from Nairobi.
Spokesperson for the National Drug Law Enforcement Agency, Mr. Mitchell Ofoyeju, said that hours after he was placed in seclusion and under observation, Ogochukwu excreted 66 wraps of heroine weighing 1.1kg.
That was when he started to beg officials of the agency.
The suspect, who was returning from Nairobi, Kenya, said his four-year-old son was on hospital admission over a life threatening ailment.
Ogochukwu, an Anambra State indigene, explained that he decided to smuggle the drugs to save the life of his son.
He said, “I teach in a computer school at Onitsha, Anambra State. This is my very first time of having anything to do with drugs.
"The doctor said that my child has a hole in the heart. I met many people for help but nobody was willing to help me except a drug baron. My son is currently at a hospital in Nairobi with my wife who is Kenyan.
“The baron who is from Tanzania promised to pay me $2,000 to take care of my child’s medical bills. I took the decision to smuggle the drugs into Nigeria because I am very worried about the condition of my son".
The Chairman of NDLEA, Col. Muhammad Abdallah, said the excuse Ogochukwu gave for his involvement in drug smuggling was not tenable.
“No explanation is tenable for committing a crime. Drug trafficking is a criminal offence and the suspect will be charged accordingly. The suspect’s action only complicated his condition because he is here facing a criminal charge while the responsibility of taking care of his sick son now rests solely on the wife.”
If convicted, the NDLEA said the suspect is facing a minimum of fifteen years imprisonment.
